The NBA legend Testifies He Felt No Fear of Nascar in Antitrust Trial
Michael Jeffrey Jordan, introducing himself formally in a federal courtroom on Friday, admitted that his competitive side and status as a newcomer motivated his push for 23XI Racing to “challenge” Nascar over perceived violations of antitrust rules.
Financial Stakes and a Will to Win
Jordan shared operational insights of his 23XI team, revealing he put in $40m of his own funds into the Nascar Cup series team launched with business partner Curtis Polk and driver Hamlin.
“It fell to someone to act,” Jordan stated during testimony. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar as a whole. From my perspective, the sport it needed to be looked at from a different view.”
Central Issue: Charter Agreements and Contract Pressure
At issue is the expiration of a 2016 agreement where Nascar provided each team a “charter”. This system mirrors other major leagues with separately owned franchises, such as the Charlotte Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar insisted on charter membership renewals.
Jordan testified for an hour and exited the courthouse to a media frenzy, with onlookers and reporters clamoring for a view or a photo of the sports legend.
Leading the Legal Charge
Jordan’s 23XI is leading the full-court press along with another racing team for Nascar to overhaul a operating model Jordan contended is breaking the law to maintain excessive control.

“Denny convinced me adding a third car improved our chances to win,” he said, sharing that he bought a third charter late in 2024 for $28 million amid the legal dispute. “So I dove in.”

Gibbs described her request for permanent charters, submitted in a formal letter to Nascar. She said the timing of the signature deadline was problematic.
According to her, the team founder first tried to call and persuade Nascar against demanding signatures, but CEO Jim France declined the request.
“Please don’t force this on us,” Gibbs recounted Joe Gibbs told Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If there are 30, that’s the number.”
